Trading Basis — Business-to-Business (B2B)

All sales by Fence Hire (Southern) Ltd are made on a business-to-business (B2B) basis. When you place an order through this website you tick a declaration at checkout confirming that the purchase is being made in the course of a trade, business, craft or profession.

This means your purchase is governed by the contract you accept at checkout (these Terms of Service together with our Refund & Returns Policy), the Sale of Goods Act 1979 (as amended) and general English contract law — not by the consumer-only protections of the Consumer Rights Act 2015 or the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

The 14-day "cooling-off" period that applies to consumer distance sales does not apply to orders placed with us. Cancellation, return and refund rights are exactly as set out in section 5 below and in our Refund & Returns Policy.

  • The website is provided for placing trade orders and obtaining product information, and may not be used for any illegal or unauthorised purposes.
  • You agree not to engage in any activity that disrupts or interferes with the functionality or security of the website.
  • Any information you provide must be accurate, complete and up-to-date, including the B2B trading declaration made at checkout.

3. Orders and Payments

  • Placing an Order: Orders can be placed through our website. By placing an order, you confirm that the details you provide are accurate, that you have the legal authority to purchase the goods, and that you are placing the order in the course of a trade, business, craft or profession.
  • Payments: Payments must be made using the methods available on our website. We use third-party payment providers, such as Stripe, to process card transactions securely. BACS bank transfers are also accepted. You further acknowledge that payment by card is made using a business or commercial payment method and not a personal consumer card
  • Card Processing Fees (Business Customers): Where a business customer chooses to pay by commercial or corporate debit or credit card, and a refund is issued for a cancelled or amended order that is not due to defective goods or our breach of contract, the refunded amount may exclude the original card processing fee charged to us by our payment provider. Any such deduction is strictly limited to the exact, non‑recoverable card processing cost actually incurred by us for that transaction. No additional handling, administration or surcharge fees are applied, and we do not profit from this deduction.
  • Order Acceptance: Orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion. Where we cancel an order before dispatch, any sum paid will be refunded in full (except for card processing fees retained by our payment provider as described above and in our Refund & Returns Policy).

4. Pricing and Availability

  • All prices displayed on our website exclude VAT unless stated otherwise. Delivery charges are calculated separately and displayed at checkout.
  • We strive to ensure that pricing and availability are accurate; however, errors may occur. If we discover an error in the price or availability of a product you have ordered, we will inform you promptly and provide the option to reconfirm or cancel your order.

5. Delivery and Returns

Delivery charges

Delivery charges are calculated based on your location and order size. They are non-refundable unless the return is due to a manufacturing defect.

Returns

Our returns policy depends on how the goods reached you:

  • Collected from our yard: Not eligible for return or refund, except where the goods are faulty.
  • Delivered goods returned to us: A 5% restocking fee applies to the value of any items returned — for example, if the customer changes their mind about quantity on delivery, orders the wrong item, or sends unused stock back with the driver.
  • Not yet dispatched:Orders may be amended or cancelled before they leave our yard. BACS payments are refunded in full. Where a business customer has paid by commercial or corporate card, any refund issued for cancellation may exclude the original non‑recoverable card processing fee charged to us by our payment provider, capped strictly at the amount actually incurred. This does not apply to refunds issued for defective goods.
  • Defective goods: Refunded in full, including delivery, whether they were delivered or collected.

Condition of returned goods

All returned goods must be in the condition they were received. For items returned due to a defect, collection is at our cost.

  • Subject to the exclusions below, our total aggregate liability to you for any claim arising under or in connection with the contract, whether in contract, tort (including negligence), breach of statutory duty or otherwise, will be limited to the price paid by you for the goods giving rise to the claim.
  • We will not be liable for any indirect, incidental, special or consequential loss, including loss of profit, loss of business, loss of contracts, loss of goodwill or loss of anticipated savings, howsoever arising.
  • Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
  • Implied terms as to satisfactory quality, fitness for purpose and correspondence with description under the Sale of Goods Act 1979 apply to our supply of goods. Other implied terms, warranties or conditions are excluded to the fullest extent permitted by law.
